Terms of Service

These terms cover the work OSR Dumpster Rental and Tree Service(“OSR,” “we,” “us,” or “our”) performs for our customers. Please read them before booking a job or requesting a quote. By hiring us, accepting a written or verbal estimate, or renting a dumpster from us, you agree to these terms.

1. Acceptance of these terms

By requesting a quote, scheduling service, allowing us onto your property, or signing any written estimate or rental agreement, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, please do not use our services. If you are booking on behalf of a business, landlord, HOA, property manager, or another party, you represent that you have authority to bind that party to these terms.

2. What we do

OSR is a family-owned crew based in Fallbrook, California. We provide the following services in San Diego County and Southwest Riverside County:

  • Junk removal and hauling — furniture, appliances, e-waste, yard debris, construction leftovers, and general non-hazardous waste.
  • Dumpster rentals — roll-off containers delivered to your property for a defined rental period.
  • Demolition — interior tear-outs, sheds, decks, small structures, concrete removal, and comparable light demolition work.
  • Tree service — trimming, removal, and cleanup of debris generated by the work.
  • Property cleanouts — estate, foreclosure, rental turnover, garage, storage unit, and hoarding-condition cleanouts.

The exact scope of any job is defined by the written estimate, invoice, or rental agreement for that job. We reserve the right to decline or stop work that is unsafe, misrepresented, or outside the agreed scope.

3. Quotes, estimates, and pricing

Quotes and estimates are based on the information you provide and, where possible, an on-site walkthrough. A firm price is only guaranteed after we have physically seen the material or scope of work. If the actual conditions differ from what was described — more volume, heavier materials, added access difficulty, or additional items — we will explain the change and confirm the revised price with you before proceeding. Verbal quotes are estimates only until confirmed in writing (text or email counts as writing).

Unless otherwise stated, quotes exclude taxes, permit fees, dump fees for prohibited materials, and any charges from third parties (utility marking, inspectors, disposal facilities that assess per-item fees, etc.).

4. Scheduling, access, and cancellations

We’ll agree on a service date and, when possible, an arrival window. Weather, prior-job overruns, and safety issues can shift arrival times — if that happens, we’ll contact you as soon as we know. You are responsible for ensuring that we can safely access the property, materials, and any dumpster placement location on the scheduled date.

You may reschedule or cancel a job by contacting us as far in advance as possible. Cancellations made less than 24 hours before a scheduled arrival, or trips where our crew arrives on-site and cannot perform the work through no fault of ours (locked gate, item no longer available, access blocked, etc.), may be subject to a trip charge that reflects our travel and reserved time. We will tell you before charging one.

5. Your responsibilities

To keep every job safe and on-budget, you agree to the following:

  • Ownership and authority. You own the items being removed, or have permission from the owner to have them removed. You have the right to authorize demolition or tree work on the property in question.
  • Permits and approvals. You are responsible for obtaining any permits, HOA approvals, tree-removal permits, or right-of-way approvals required for the work at your property. We are happy to advise, but we do not pull permits on your behalf unless agreed in writing.
  • Property access. Provide clear access to the work area and, for dumpsters, a suitable drop location that will bear the weight of a loaded container and does not obstruct driveways, utilities, or public rights-of-way without permission.
  • Utilities and marking. For demolition, digging, or tree work near underground lines, you are responsible for arranging utility locates (call 811 in California) before we begin.
  • Prohibited materials in dumpsters. Do not place the following in a rented dumpster: hazardous waste; paint, solvents, fuels, and oils; batteries; propane or other pressurized tanks; asbestos; medical or biohazard waste; tires; refrigerators or other appliances containing refrigerant unless pre-arranged; items containing Freon; contaminated soil; or any material prohibited by California law or the receiving landfill. If prohibited material is loaded, additional fees, sorting charges, or fines assessed by the disposal facility will be billed to you.
  • Dumpster weight and fill limits. Do not overload the dumpster past its rim or the agreed weight limit. Overweight loads may incur additional per-ton charges and, in some cases, may not be picked up until the overage is removed.

6. Payment

Unless otherwise agreed in writing, payment is due upon completion of the work or, for dumpster rentals, at the time of delivery. We accept the payment methods listed on the invoice. A deposit may be required for larger demolition, tree, or multi-day jobs, and will be credited against the final invoice.

Invoices not paid by their due date may be subject to a late fee of the lesser of 1.5% per month or the maximum rate allowed by California law. You agree to reimburse us for reasonable collection costs, including attorney’s fees, if we are forced to pursue an unpaid balance.

7. Property, damage, and site conditions

We take reasonable care around your property, but heavy trucks, dumpsters, and demolition work carry inherent risks. When you direct us to drive, place a dumpster, or work on softscape, driveways, paver surfaces, lawns, curbs, or other surfaces that may be marked, cracked, indented, or stained by the work, you accept the risk of ordinary marks and settling associated with that use. We are not responsible for pre-existing damage, cosmetic marks in driveways or lawns caused by the placement or removal of a dumpster, or damage caused by hidden conditions (buried lines, irrigation, septic components, uncharted structures) that were not disclosed or locate-marked before work began.

If we cause damage through our negligence, contact us within seven (7) days so we can inspect and, where appropriate, repair it or work with our insurance.

8. Disclaimers and limitation of liability

Except as expressly stated in these terms or a written estimate, our services are provided “as-is” and without warranties of any kind, express or implied, to the fullest extent permitted by California law. We do not guarantee that removed items can be donated or resold, that a tree will survive trimming, or that a demolition site will be free of unforeseen conditions.

To the fullest extent permitted by law, OSR’s total liability for any claim arising out of or relating to a job is limited to the amount you paid us for that specific job. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, loss of use, or the value of items removed, even if we’ve been advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under California law.

9. Indemnification

You agree to indemnify and hold harmless OSR, its owners, and its employees from claims, losses, and expenses (including reasonable attorney’s fees) arising out of: (a) your breach of these terms; (b) your misrepresentation of the work, the items being removed, or ownership; (c) the presence of hazardous, prohibited, or misdescribed materials placed in a dumpster or handed off to our crew; or (d) damage or injury caused by unmarked utilities, hidden conditions, or third parties on the property.

10. Governing law and venue

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or a job we performed will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

11. Changes to these terms

We may update these terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page. The version in effect on the day you booked or accepted a quote is the version that governs that job.
